7.6 Documentation Requirements for Defensibility

Implementation and Behaviour

  • Noise risk assessments: Demonstrating that risks have been identified and assessed.
  • Noise control programme: Evidence of measures taken to reduce noise at source.
  • Hearing protection selection records: Justification for the choice of protectors.
  • Fit test records: Demonstrating that the adequacy of the selected protectors has been verified for each individual. The PAR for each worker should be recorded.
  • Training records: Evidence that workers have been trained in the correct use of their hearing protection.

What it is: In the event of a civil claim for noise-induced hearing loss, the employer will need to provide evidence that they have taken all reasonably practicable steps to protect their workers' hearing.

  • Noise risk assessments:

Demonstrating that risks have been identified and assessed.

  • Noise control programme:

Evidence of measures taken to reduce noise at source.

  • Hearing protection selection records:

Justification for the choice of protectors.

  • Fit test records:

Demonstrating that the adequacy of the selected protectors has been verified for each individual. The PAR for each worker should be recorded.

  • Training records:

Evidence that workers have been trained in the correct use of their hearing protection.

  • Health surveillance records:

Audiograms and records of any actions taken.

  • Maintenance records:

Evidence that hearing protection and other control measures have been maintained in good working order.

Why it matters: Comprehensive documentation is essential for demonstrating compliance with the Control of Noise at Work Regulations and defending against potential legal claims. Fit test records provide powerful, individual-specific evidence that the employer has gone beyond basic compliance to verify protection. Related: [#cnawr-health-records](#cnawr-health-records).
